Terms and Conditions

​1. This policy contract governs the legal relationship between aYo Uganda Limited and the Policyholder. The policy sets out the aYo aYo Recharge with Care Terms and Conditions, underwritten by Metropolitan Life Uganda and is also available on the following website: www.ayo.co.ug.
2. aYo reserves the right to update Terms and Conditions if deemed necessary. The onus will rest on the Policyholder to review the changes by accessing the updated Terms and Conditions on the aYo website.
3. aYo Recharge with Care consists of a range of benefit components. These Terms and Conditions shall apply to both benefit components purchased on or after 23 August 2016, subject to any updates made to the Terms and Conditions thereafter.
4. Accidental Hospitalisation: At least 1 (one) overnight stay in hospital due to an accident/trauma event where an accident/trauma event is defined as a bodily injury caused by accidental violent external and visible means that directly and independently of all other causes results in the insured person’s hospitalisation.Examples of accidents/trauma events include road accidents, fire or violence.
5. Insured Event: Any event upon which a MyLovedOne or Policyholder is eligible to receive policy benefits under this policy contract.
6. MyBonus: Policyholders are rewarded with MyBonus value by performing specified actions within the aYo USSD menu. MyBonus may be used by the Policyholder once it has reached the MyBonus Threshold.
7. MyHospital: Cover for hospitalisation due to an accident/trauma event that resulted in at least 1 (one) overnight stay in hospital.
8. MyLife: Cover for death of the Policyholder.
9. MyLovedOne: The person (beneficiary) receiving the insurance benefits following a successful claim. . All beneficiaries must be natural persons.
10. Policyholder: The individual who is the user and owner of the MTN Uganda cellphone number who successfully registered for aYo Recharge with Care. The Policyholder will always be the life insured.
11. Premium: The consideration payable in order to purchase additional cover. No Premium is payable by the Policyholder free cover linked with MTN airtime recharge.
12. A Subscriber, a registered MTN Uganda prepaid customer who is subject to the MTN Prepaid Conditions of Use and user of the applicable cellphone number, shall have deemed to have satisfied eligibility conditions if he/she:
is older than age 18 (eighteen) last birthday and not older than age 65 (sixty five) last birthday at the time when the Subscriber registers for aYo Recharge with Care;
is a Ugandan citizen and also resident in Uganda;
has given consent to register for aYo Recharge with Care through the aYo USSD menu, aYo call centre or aYo agents and confirmed that he/she acknowledges that he/she has read through and understand these Terms and Conditions;
13. If you are an existing MTN141 loyalty programme subscriber or an existing MTN Cashback loyalty programme participant, you hereby agree and understand that by registering for aYo Recharge with Care, you will receive the benefits of aYo Recharge with Care going forward and will forfeit your MTN141 loyalty programme membership or your MTN Cashback membership and will not be able to accumulate further benefits to either the MTN141 loyalty programme or to the MTN Cashback programme.
14. The cover shall commence on the day the registered Subscriber recharges with MTN airtime and/or buys additional cover through using MTN airtime or through MTN Mobile Money.
15. The cover term for each successful cover transaction will always be for a maximum period of 36 (thirty six) full consecutive days from the date the cover commences where a minimum cover term is equal to 30 (thirty) consecutive days from the date the cover commences.
16. Subject to the policy Terms and Conditions, the cover becomes payable only on:
Death of the Policyholder for the MyLife insurance benefit.
Hospitalisation of the Policyholder due to an accident/trauma event that resulted in at least 1 (one) overnight stay in hospital for the MyHospital insurance benefit.
17. The Insured Events covered are limited to events within the borders of Uganda only.
18. Maximum insurance cover levels may be different per cover where the maximum will be applied at point of recharge and/or policy cover purchase.
19. aYo reserves the right to increase or decrease the maximum policy cover levels without notification to the Policyholder.
20. aYo reserves the right to restrict/decline the allocation of cover through either the recharging of MTN airtime or buying of additional cover using MTN airtime or through MTN Mobile Money
21. aYo shall verify the eligibility of all claims and may request documentary proof of identification as well as proof of the Insured Event.
22. aYo reserves the right to route the claimant, the person initiating and driving the claims process, to a claims repudiation process if required.
23. Claims must be submitted within 30 (thirty) full consecutive days of the date of death (in the case of a MyLife claim or the date of accident/trauma in the case of a MyHospital claim).
24. The acceptance and processing of a claim does not in any way imply that a claim has been admitted for payment. This decision to 
admit or repudiate a claim shall remain within the sole discretion of Metropolitan Life Uganda.
25. In the case where a Policyholder is found to be registered for aYo Recharge with Care on more than one cellphone number, the maximum pay out for 1 (one) event on any 1 (one) life insured is the specified maximum cover level as per clause 18 above.
26. The frequency of MyHospital claims are limited to 3 (three) claims per 12 (twelve) month rolling period, subject to a minimum period of 30 (thirty) days between claimable Insured Events.
27. In the event that the time of admission to hospital is more than 24 hours from the time of accident/trauma event, aYo reserves the right to scrutinise and reject the claim if it believes hospitalisation was not caused by the event.
28. For Hospital & Life cover to pay out, cover must have been bought prior to the accident/trauma event date resulting in admission to hospital for the hospital benefit, and cover must have been bought prior to the date of death for the life benefit. The claim amount shall therefore be the applicable cover amount accumulated as on the day before the claim event date.
29. Claims will NOT be paid under the following circumstances:
If any material information in any relevant document (such as the death certificate) is incorrect or incomplete, or if any other relevant material information is withheld;
If the Policyholder or Claimant commits fraud or attempts to commit fraud against aYo when claiming benefits under the policy;
If aYo is not notified within the minimum required time after the claim event occurred;
If the claim was caused, directly or indirectly, by active participation in war, invasion, acts of foreign enemies, hostilities, warlike operations (whether war be declared or not), civil war, rebellion, revolution, insurrection, civil commotion assuming the proportions of or amounting to an uprising, military or usurped power;
30. This policy shall not attain any surrender or loan value and therefore no benefits can be paid unless the Insured Event on which the benefit amount is payable has occurred.
31. A Policyholder can cancel the policy at any time. However, no refund of Premium(s) shall be made, all policy cover yet to expire shall be terminated with immediate effect and non-used MyBonus shall be forfeited.
32. A Policyholder can reinstate the policy at any time registering to aYo Recharge with Care as a new policy with all relevant Terms and Conditions of a new policy applicable.
33. The benefits on a policy linked to a cellphone number, cannot be transferred to another cellphone number where the Policyholder changes cellphone numbers.
34. The policy has a 0 (zero) days waiting period from the commencement date of insurance cover in which only deaths arising from accidents are payable.
35. The policy cover cannot be sold or exchanged for cash.
36. The policy cover shall be governed and construed in accordance with the Laws of Uganda.
37. aYo and Metropolitan Life Uganda reserves the right to adjust Premium(s) at a 1 (one) days' notice.
38. aYo shall be free from all obligations under this policy if at any time it is found that there has been wilful or fraudulent misrepresentation by the Policyholder, in which all monies paid to (or payabe by) aYo shall be forfeited.
39. Cover under the policy shall be deemed to have ceased upon payment of the MyLife Benefit.
40. aYo and MTN will, in relevant cases, disclose your personal information to each other, our service providers and business partners and by accepting the aYo Terms and Conditions, you agree and consent that we may process, record and/or disclose your personal information, including details of your transactions on your MTN account with aYo.
41. You further agree and consent that we may process, record and/or disclose your personal information, including details of your transactions on your account with aYo partners and service providers.
42. To the extent lawful we may transfer or otherwise authorize the use of any of your personal data and information.
