ADVANCING WOMEN ENTREPRENEURS (AWE) PROJECT
TERMS AND CONDITIONS

Background

MTN Uganda Limited, in partnership with MTN Mobile Money Uganda Limited, American Tower Company, UN Women, dfcu Bank, Innovation Village and National Social Security Fund (NSSF) HI Innovators is committed to launching Advancing Women Entrepreneurs (AWE) project. The purpose of this project is to empower female entrepreneurs within the technology sector.
These are the Terms and Conditions that govern the Advancing Women Entrepreneurs (AWE) project and constitute the agreement between you and MTN Uganda Limited. These Terms and Conditions expressly delineate the rights and obligations exercised under the Project.
By signing below or by submitting your application on the MTN Website, you confirm that you have read these Terms and Conditions and that you agree to be bound by them. If you dissent from any part of these Terms and Conditions, you are ineligible to participate in the project.
Duration

The Campaign will run for a period of Three (03) Years from 2 October 2023 to 6 November 2026.

Application and Entry

I. I/ We acknowledge that the purpose of the project is to empower women entrepreneurs in the technology sector.

II. I/ We understand the nature of the project and by agreeing to the Terms and Conditions, I/ We hereby consent to the recording and use of my/ our contribution to the project in accordance with the terms and conditions herein stated.

III. There is no entry fee to the Advancing Women Entrepreneurs (AWE) Project.

IV. Multiple entries of the same project shall be disqualified.

V. All Applications MUST be submitted online by submitting a completed application form via the MTN website – www.mtn.co.ug

Eligibility

I. All Applicants must be 18 years and above to participate.

II. All female Ugandan entrepreneurs are eligible to participate.

III. The project is open to female entrepreneurs running the following businesses.

  • Limited Liability Companies
  • Sole proprietorships
  • Joint Venture Businesses
  • Business Associations

IV. Applicants with criminal records shall be automatically disqualified.

Criteria for Project Selection

I. The applicants will be expected to participate in the Procurement technology categories of;

  • IT equipment and related services
  • Network services
  • Digital products and accessories
  • Engineering services
  • Professional training services

II. The Applicants MUST submit their applications before November, 6th 2023 5pm.

Indemnity

I. I / We hereby indemnify and hold harmless MTN Uganda Limited, its affiliated entities and its officials, agents, volunteers, and employees against and liability, injury, or death that I/We may sustain as a result of participating in any and all activities connected with or associated with the Advancing Women Entrepreneurs (AWE) project.

II. I/We agree to indemnify and hold MTN Uganda Limited, its affiliated entities, and their respective employees, officers, agents, licensees, and assigns, harmless from any claim and/or liability arising from my/ our failure to obtain the permissions and grants of authority described in these terms and conditions including all claims for infringement of copyright or any form of intellectual property.

III. I/We further agree to indemnify MTN Uganda Limited, its affiliated entities, and their respective employees, officers, directors, agents, licensees, and assigns, harmless from any and all liability howsoever arising including oversight, negligence, or willful misconduct.

Intellectual Property

I. I/We represent and warrant to MTN Uganda Limited that all videos and information submitted to MTN Uganda Limited are original and shall not infringe upon or violate any patent, copyright, or proprietary right of any person or third party.

II. I/We grant full authority, copyright, and other proprietary rights `of all my/our recordings (audio, visual and photos) under this Programme to be used by MTN Uganda Limited.

III. MTN Uganda Limited has the right to remove and/or reject any video or information that violates the intellectual property rights of others (including trademark, copyright, and other proprietary rights) or content that encourages or induces infringement of intellectual property rights.

Rights of MTN Uganda Limited

I. MTN Uganda Limited reserves the right to choose who takes part in the Advancing Women Entrepreneurs (AWE) Project based on the online submissions. Contestants will be notified via email should their application be successful or not and the next steps.

II. By Participating in the Advancing Women Entrepreneurs (AWE) project, you further grant and assign to MTN Uganda Limited an irrevocable, perpetual, royalty-free, transferable license to use the content submitted for Media, Public Relations (PR) and any other communication related activities.

III. By participating in this Project, you explicitly agree and provide consent to MTN Uganda Limited for the collection, utilization, and retention of the personal information you furnish, for all purposes connected with the Project. These purposes encompass, but are not limited to, promoting, processing, and administering entries, sharing an entrant’s personal information with MTN Uganda Limited’s partners, service providers, and contractors as necessary to conduct and operate the Project, communicating with selected Participants, making public announcements about selected Participants, and advertising, promoting, and publicizing this Project.

IV. You also acknowledge that your information may be subject to the privacy policies of third parties and understand that the use of your data by any such third party is subject to the applicable privacy policy and that MTN Uganda Limited is not responsible for such use.

General Terms

1.1. Any communication or material you do submit will be treated as non-confidential and non-proprietary. Anything you submit shall be deemed the property of and may be used by MTN Uganda Limited, its affiliates, for any purpose, including, but not limited to, reproduction, disclosure, transmission, publication, broadcast and posting.

1.2. MTN Uganda Limited may edit, copy, publish, distribute, translate, and otherwise use in any medium any submission that you forward to MTN Uganda Limited and will own exclusively all such rights, titles, and interest and shall not be limited in any way in its use, commercial or otherwise, of the submission. MTN Uganda Limited is and shall be under no obligation to: (1) maintain any applicant’s submissions in confidence; (2) to pay any applicant’s compensation for any submissions.

1.3. The Advancing Women Entrepreneurs (AWE) project will be cancelled where it is void in whole, or in part prohibited by Law.

1.4. MTN Uganda Limited is not responsible for any application that is incomplete or incorrect, or for any failures, errors, or delays with respect to submission of any application.

1.5. Any attempt by you to deliberately interfere with or manipulate the Project may be a violation of criminal and/or civil Law and may result, among other things, in disqualification from the Project.

1.6. MTN Uganda Limited reserves the right, without prior notice and at any time, to terminate or suspend the Project, in whole or in part, or to modify the Project should any factor (including but not limited to fraud or copyright infringement) interfere with the Project as contemplated by these terms and conditions or if MTN Uganda Limited believes that the Project has been or will be compromised in any way.

1.7. If You have any concern or dispute about the project, You agree to first try to resolve the dispute informally by contacting the Company via email awomenentrepreneurs.ug@mtn.com.

1.8. We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

1.9. Ugandan Law shall govern this Project and any litigation of a dispute arising out of, or in connection with the Project shall be subject to the sole and exclusive jurisdiction of Ugandan courts.

1.10. By participating, you irrevocably submit to the sole and exclusive jurisdiction of such courts for such purpose and waive any objection in connection with the same.
