1. Introduction1. Introduction

These Terms and Conditions (the “Terms”) govern the use of the Weekend Agent Float Loan facility. They become effective when you access the Weekend Agent Menu or obtain the Weekend Agent Float Loan facility. These Terms are designed to enhance your loan experience, mitigate risks associated with online transactions, and clearly outline the rights and obligations of all parties involved. Please read them thoroughly before utilizing the Weekend Agent Float Loan facility.

2. Definitions2. Definitions

For the purposes of these Terms, the following definitions shall apply:

  1. Account: A mobile money wallet maintained by MTN Mobile Money (U) Limited under the customer’s name, representing electronic monetary value.
  2. Credit Limit: The maximum pre-approved borrowing amount available under the Weekend Agent Float Loan facility from dfcu Bank Limited.
  3. Credit Reference Bureau: A licensed entity responsible for collecting and sharing customer credit information in accordance with Ugandan laws.
  4. Borrower: An agent registered in the MTN Mobile Money system with valid identification who has accessed the Weekend Agent Float Loan facility.
  5. E-Money: The electronic monetary value represented in an MTN Mobile Money account, equivalent to a specified cash amount.
  6. Weekend Agent Float Loan facility: The loan facility requested and obtained by a customer from dfcu Bank Limited through their registered agent mobile number (MSISDN). The loan credited on the wallet will be less the amount of access fees. 
  7. MSISDN: The Mobile Station International Subscriber Directory Number, a unique identifier for a mobile subscriber/phone owner.
  8. MTN Mobile Money Menu: The menu accessed by MTN Mobile Money customers and agents to initiate various MTN Mobile Money services.
  9. System: The electronic lending and communication platform used by dfcu Bank Limited to facilitate access to the Weekend Agent Float Loan facility.
  10. Lender: dfcu Bank Limited, a financial institution incorporated as a limited liability company under the Companies Act with its principal office at Plot 26 Kyadondo Road, Nakasero, P.O. Box 70 Kampala, Uganda.
  11. Repayment Date: The date on which repayment of the Weekend Agent Float Loan facility is due.
  12. Request: An instruction submitted to dfcu Bank Limited by a customer via the MTN Mobile Money drop-down menu.
  13. Mobile Money: A money transfer and payment service provided by MTN Mobile Money Uganda Limited.
  14. Penalty Interest: A charge of 1% applied for a maximum of 2 days for overdue amounts.
  15. Access Fees: A flat fee charge of 1.5% for a 3-day loan tenure, calculated from the disbursement date.
  16. MTN Mobile Money Uganda Limited Services: All services offered via the MTN Mobile Money menu via *165#.
  17. Mobile Money Provider: A mobile network operator authorized by the Central Bank of Uganda to provide mobile money services.
  18. Device: A customer’s mobile phone, SIM card, or any other device facilitating access to the Weekend Agent Float Loan facility.
  19. “You” or “your”: Refers to the customer, including personal representatives, assigns, and legal representatives.
  20. Customer: This term encompasses all genders and legal entities.
  21. Singular and Plural Terms: Words denoting singular meanings shall also encompass plural meanings, and vice versa, as context permits.
  22. Agent: means a person that does cash in, cash out and assisted payments on the MTN Mobile Money Uganda Limited Services platform.
  23. Maximum Tenor: This is 3 days.
3. Loan Access and Authorization3. Loan Access and Authorization
  1. By opting into the Service, you confirm that you are least eighteen (18) years old and a registered and active MTN Agent for at least six (6) months immediately preceding the date of your application to register for the Service. We reserve the right to verify the authenticity and status of your MTN Account and transactions and may decline your application if we are not satisfied that you have met these minimum requirements.
  2. The Weekend Agent Float Loan facility is accessible only between Friday 00:00 and Sunday 23:59.
  3. Any instructions for accessing or obtaining the Weekend Agent Loan facility made using your credentials shall be deemed to have been initiated and authorized by you.
  4. The lender provides this service exclusively through electronic means via the MTN Mobile Money Agent App/USSD menu *165#. Acceptance of these Terms constitutes sufficient notice, consent, or approval.
4. Eligibility and Approval4. Eligibility and Approval
  1. Without prejudice to the lender’s discretion in granting the Weekend Agent Float Loan facility, the availability of this loan facility is subject to the following conditions:

    1. The Borrower must meet the eligibility criteria established by the lender.
    2. The Borrower is responsible for settling all applicable fees and interest, including Penalty Interest, where applicable.
    3. The lender reserves the right to approve or reject any loan application without obligation to provide a reason.

  1. By electronically applying for and accepting these Terms, you consent to dfcu Bank Limited (dfcu) and MTN Mobile Money (U) Limited (MTN MoMo) sharing your personal details, including registration details and National Identification Number (NIN), with any Credit Reference Bureau for credit rating, scoring, reporting, and recovery purposes.
  2. Information regarding defaults may also be shared with the Lender for collection and recovery purposes.
  3. By applying for or using credit facilities with us, you authorize us to obtain and review your credit report and credit score from credit reference bureaus to assess your creditworthiness. We will assign a credit limit to your wallet based on this assessment and reserve the right to review, adjust, or revoke this limit at any time based on changes to your credit score, payment history, or our risk policies. Your payment history will impact your credit score and credit limits assigned to your wallet. We will notify you of your initial credit limit and any material changes to it as it gets updated.
6. Loan Repayment6. Loan Repayment
  1. The entire outstanding loan amount, including accrued interest, penal Interest and any applicable fees or charges, shall become immediately due and payable upon default.
  2. Any amount not repaid by the due date shall accrue a Penalty Interest of 1% (one percent), charged for a maximum of 2(two) days, after which the amount due will be auto collected from the Borrower’s account. 
  3. The Lender shall deduct outstanding amounts directly from the Borrower’s mobile money account.
  4. The Borrower may make early payments toward their Weekend Agent Float Loan facility.
7. Access Fees and Charges7. Access Fees and Charges
  1.  Access Fee: A charge of 1.5% flat fee for a 3(three)day loan tenure, calculated from the disbursement date.
  2. Penalty Interest: A daily charge of 1% for a maximum of 2(two) days after the repayment date for overdue amounts.

All transactions under these Terms shall be conducted in Uganda Shillings.

9. Set Off9. Set Off

The Bank may at any time and without notice to the Borrower combine or consolidate all or any of the Borrower’ accounts with the Bank and set-off any matured obligation owed by the Borrower against any obligation (whether or not matured) owed by the Bank to the Borrower, regardless of the place of payment, booking branch or currency. The Borrower hereby expressly authorizes the Bank to combine, consolidate or off set its accounts. The Bank will not require any additional authorization from the Borrower prior to such set-off, combination or consolidation

10 . Anti Bribery & Anti-Corruption10 .  Anti Bribery & Anti-Corruption

The Parties hereto shall comply with all applicable laws, statutes, regulations, policies and procedures relating to and governing anti-bribery and anti-corruption including but not limited to the Anti-Corruption Act 2009, and the Bank’s related policies and procedures. The Parties shall not engage in any activity, practice or conduct which would constitute an offence under the Act or policies. The Parties shall not, and shall procure that their employees, agents and sub-contractors shall not offer, solicit or accept an inducement/advantage in connection with the service under the contract.

11. Governing Law and Amendments11. Governing Law and Amendments
  1. These Terms and Conditions are governed by the Laws of Uganda and constitute the full agreement governing the relationship between the Borrower and the lender regarding the Weekend Agent Loan facility.
  2. The Lender reserves the right to amend these Terms at any time. Notice of any amendments shall be communicated via the lender’s official channels and shall be binding upon continued use of the loan facility.
12. Taxes12. Taxes

All Repayments are inclusive any taxes payable by you. You hereby irrevocably grant us permission to revise the Interest and Fees upon any changes to taxes applicable.

13. Customer Complaints13. Customer Complaints

 

  1. Complaints shall be made by calling the helpline 100, WhatsApp      0772123100, or 128 which is for MTN MOMO Agents support. Alternatively, you can visit any MTN shop.
  2. We, on receiving a complaint, shall provide the complainant with a prompt  acknowledgement within forty-eight (48) hours and resolve the complaint in seven (7) working days. For complaints not resolved within seven (7) working days, updates should be forwarded to the customer on the progress in resolving the complaint, once in every seven days.
